Spacegoogie Posted May 6, 2024 Posted May 6, 2024 I am wondering what measures on a personal level that can be taken if someone uses your art, design or something you made for a personal finical gain, In the US and out? Has anyone had any experience with this? We are an Amazing community!
Rappelbox Posted May 6, 2024 Posted May 6, 2024 if it's your own IP you have to decide wether its worth to go after someone... probably not worth to involve any lawyer if you're using other peoples IP and made a "fan thing" from it, then better say nothing as the original IP holder can go after YOU, too or did i missunderstood somethig? sorry, english is not my native language although i read and write on an almost daily basis
(What I mean is, If I made something of my own and uploaded it here and I find out that a company has downloaded my shared content from here to sell with there pinball cabinet, I have always been under the impression that this was a copy right issue and violated laws? In fact there is a statement right here on VPU about it. So I'm asking what can I do about a violation? Are these laws even enforced? Thank you for your input.)
Rappelbox Posted May 7, 2024 Posted May 7, 2024 theoretically you could go after them. And depending on the country they're living in you could be lucky, or not. I'd try to contact them first in private and discuss your concerns.
Tikimaster Posted May 7, 2024 Posted May 7, 2024 (edited) Quote: Quote Pack/Drive and Cabinet Sellers: Selling software packs or drives that contain any content from this site is strictly prohibited. This includes tables, ROMs, backglasses, media, etc. Basically any content that you didn't create yourself cannot be sold. Downloading and configurating does NOT give you the rights to sell any content from this site. Cabinet sellers including the Visual Pinball, Future Pinball, PinMAME, or frontend software are doing so ILLEGALLY. There are a couple cabinet builders that have agreements with frontend developers to include the frontend; they should disclose this information. However, this does not give cabinet sellers the rights to include any games or community created content on your machines. If caught; you will be blacklisted from this site as well as other related communities. The question is, is this graphic subject to copyright protection? I assume: Yes. What makes it really complicated now is that you would have to hire a German lawyer to pursue the matter, presumably the infringement is taking place in the USA? There would have to be a lot of financial damage for that to be worthwhile, right? Talk to the people and reach an agreement. Make it public. As annoying as it is, an expensive legal dispute in which you are still throwing money after the fact is not worth it. You would lose money on top of the hassle. Edited May 7, 2024 by Tikimaster
